3. ELIGIBILITY

You must be:

• At least 18 years of age; and
• Legally competent to enter into a binding contract under the Indian Contract Act, 1872.

If applying on behalf of a startup, you represent that you are duly authorized to act on its behalf.

4. SERVICES OFFERED

Startup IP Lab offers the following services:

• Patent filing support (provisional, complete specification, RFE)
• Trademark filing and objection responses
• Guidance and facilitation under the SIPP (Startup Intellectual Property Protection) Scheme
• Consultations, document reviews, and IP form assistance

We reserve the right to modify or discontinue any service without prior notice.

5. SIPP SCHEME COMPLIANCE

We operate as a registered facilitator under the Government of India’s SIPP Scheme. Users availing SIPP support:

• Must be DPIIT-recognized startups
• Must submit valid documentation as per SIPP guidelines
• Acknowledge that professional fees are reimbursed by the Government, not the user

We are not responsible for SIPP fee disbursements or delays caused by government processes.

6. USER RESPONSIBILITIES

You agree to:

• Provide accurate, current, and complete information
• Not impersonate any person or entity
• Cooperate in good faith during the IP filing process
• Ensure that your idea, content, or material is original and not infringing

You are solely responsible for ensuring that any information submitted is not confidential or proprietary unless we have a separate Non-Disclosure Agreement (NDA) in place.

7. INTELLECTUAL PROPERTY

All content on the website, including logos, design, text, graphics, and service structure, is the intellectual property of Startup IP Lab or its licensors and is protected under the Copyright Act, 1957 and the Trademarks Act, 1999.

Users are prohibited from:

• Reproducing or copying content without prior permission
• Using our logo, brand name, or materials for any commercial purpose without consent

8. PAYMENT TERMS

• For non-SIPP services or out-of-pocket expenses (e.g., government filing fees), you agree to pay the applicable charges.
• All payments are final and non-refundable unless explicitly stated.

We use secure third-party payment gateways and are not liable for their operational errors.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

• We shall not be liable for any indirect, incidental, or consequential damages, including loss of business, reputation, or data.
• We are not liable for rejections or delays by government IP offices (IPO, TM Registry).
• Our total liability shall not exceed the amount paid by the user for the services in question.

10. CONFIDENTIALITY

All user data and shared documents are treated as confidential and used solely for the purposes of IP facilitation. However, no attorney-client relationship is formed unless expressly agreed in writing.

For sensitive innovations, users may request a separate Confidentiality or NDA Agreement.

11. TERMINATION

We reserve the right to suspend or terminate services:

• If there is a violation of these Terms
• If false or misleading information is provided
• At our discretion, with notice

Upon termination, any pending filings will be reviewed on a case-by-case basis.

12. JURISDICTION AND GOVERNING LAW

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Darbhanga, Bihar, India.

13. MODIFICATIONS

We may update these Terms from time to time. Users will be notified via the website or email. Continued use after changes constitutes acceptance of the revised Terms.
